Zum einen ist der Gebrauch illegaler Drogen nach dem Bundesbetäubungsmittelgesetz (BtMG) strafbar, zum anderen wird der Unterhalt der Sucht häufig durch Straftaten gedeckt. Drogenabhängige Gefangene machen einen Anteil von etwa 30-40% an der Gesamtpopulation der Gefangenen in Deutschland aus. Der überwiegende Teil ist aufgrund von Beschaffungskriminalität inhaftiert, welche als Folge der hohen Kosten der Sucht häufig unvermeidlich ist.Im Strafvollzug wird das Ziel verfolgt, den Gefangenen während seiner Haftzeit zu befähigen, nach seiner Entlassung, ein Leben in sozialer Verantwortung und ohne Straftaten zu führen (vgl. § 2 StVollzG). Der Inhaftierte soll resozialisiert werden. Vor allem im Umgang mit inhaftierten Drogenabhängigen stellt dies kein leichtes Unterfangen dar und doch besteht insbesondere hier ein erhöhter Bedarf an resozialisierenden Maßnahmen. Vor allem der suchttherapeutischen Beratung scheint an dieser Stelle eine besondere Wichtigkeit und Notwendigkeit zu zukommen.
