To better understand migration governance and the concrete, daily practices of civil servants tasked with enforcing state laws and policies, it is important to focus on documents, which are core artefacts of bureaucratic work. These can include certificates, letters, reports, case files, decisions, internal guidelines and judgements, in both digital and paper form. Based on ethnographic studies in various geographical and bureaucratic contexts, this collection shows how civil servants produce statehood, restrict migrants' movements and engage with migrants' strategies to make themselves legible. It contributes to the study of the state as documentary practice and highlights the role of paperwork as a powerful practice of migration control.

Many people think that marriage petitions are easy and all they have to do is marry a U.S. Citizen or a Lawful Permanent Resident and they will easily be able to get the Green Card. They do not see the multiple issues which are present and which the immigration officer is looking for when looking at the marriage petition and conducting the immigration interview. First, the immigration officer believes every marriage is fake and that the beneficiary is trying to get married for the sole purpose to get the Green Card. Of course this is illegal and if the officer determines there is marriage fraud, then the beneficiary will not be able to get immigration benefits for life and will likely be placed into deportation proceedings. Even if there is a divorce and later a marriage occurs where there is multiple children, it will not erase the fact that the officer or immigration judge ruled that there was marriage fraud. Clearly, one of the most important factors in submitting the marriage petition is to show that there is a 'bona-fide' marriage. This is much more than simply showing some pictures. Anybody can do that to try to prove the marriage is real. This petition has a typical cover letter to address the issue of the bona-fides of the marriage. The next big issue which many people fall into is coming here to the United States on a B2 Visitor Visa and then immediately getting married to a U.S. Citizen. If this occurs within the first 90 days of entry, then it is presumed that they committed fraud and did not intend to actually come and visit the U.S. Even if they do this after 90 days, the issue does not just disappear, although it becomes much easier to get over the presumption of fraud. The cover letter here was prepared by a qualified and expert immigration attorney in the U.S. who has been practicing immigration law for nearly 30 years. It is the next best thing to having an attorney do the marriage petition without having to pay an attorney. Take advantage of this petition and show everything you can to try to get approved. Do not get lulled into the false belief that marriage petitions are easy and pose no problems. This particular sample is an adjustment of status petition where it is filed inside the U.S. and there is no need to leave the U.S. for consulate processing. It assumes there are no grounds of inadmissibility such as criminal or fraud or misrepresentation or medical or financial. If so, then you may have to submit an immigration waiver of inadmissibility along with the marriage petition and/or the person may not qualify to adjust status in the U.S. Either way, we certainly hope you find this petition useful and helpful and hope for the best immigration experience you can have. We do have petitions on every subject area of immigration and you might look at those if needed as well. If you do need to actually have a consultation, you can call our U.S. Immigration Law office at 562-495-0554 for an initial free consultation to determine what must be done to help you and your family.

This sample Business Plan has been prepared by an Immigration Lawyer with over 25 years of experience. There are charts, graphs, and market segments for exactly what the U.S. Consulate is looking for with your Business Visa Application. Whether it is an E-2 Treaty Investor Visa or L-1 lntracompany Transferee Visa or an EB-5 Investor Visa you can save thousands by using this Business Plan and altering it to your specifications. The Business Plan is a requirement of many business applications and with it, your chances of success on the visa application are much higher. There are Business Plans prepared specifically by business organizations, and then there is our Business Plan prepared by an expert immigration lawyer. It is critical when the investment visa is being adjudicated that you properly and accurately show the officer all of the necessary numbers, charts, graphs and explanations how the business will grow and what will be needed in each of the particular segments of the business. The Business Plan must be prepared with care to show growth, but to be realistic and believable. This Business Plan gives the tools for you to do this and have a higher chance of success. The investment visas which are most applicable to foreign nationals are the E-2 (treaty-investor), L-1 (intracompany transferee) and the E-1 (treaty-trader). They deal with people coming to the U.S. to start their own business or buying a business already in operation. It may involve trading with the U.S. or opening a branch office. There are several scenarios for these types of immigration visa petitions. One thing is for sure. Each one of these investment related visas and petitions must have a complex business plan with a 5 year outlook. It must be geared to meet the immigration requirements and technicalities. Of course, somebody might be able to either create their own business plan or just get a program to do it. However, what is the use of creating a business plan if it does not meet the U.S. Immigration requirements and regulations? An immigration officer or consulate officer giving the immigration interview could easily deny the entire E-2, L-1 or E-1 petition because it does not properly show the necessary data and information on the business plan. Don't shortcut this element of the petition as it is very important. Typically, there will be charts and graphs and segments and markets and various other items to indicate to U.S. Immigration or the U.S. Consulate how well the business will be doing in 5 years, that it will comply with the immigration regulations, statutes and requirements and that the officer will have the authority to approve this investment visa. The sample business plan you see will give lots of great information and a significant amount of information and data that will comply with the requirements. Thus, if you cannot hire an immigration lawyer to prepare the necessary business plan, this is the next best thing. Follow it carefully and closely and you will have a real chance of realizing your dream to come to the United States and conduct business and be the entrepreneur that you know you can be. We certainly hope you find this petition useful and helpful and hope for the best immigration experience you can have. We do have petitions on every subject area of immigration and you might look at those if needed as well. If you do need to actually have a consultation, you can call our U.S. Immigration Law office at 562-495-0554 for an initial free consultation to determine what must be done to help you and your family.

Naturalization is the legal process through which a foreign citizen or national can become a United States Citizen. In order to be naturalized, an applicant must first meet certain criteria to apply for citizenship. Then, the applicant must complete an application, attend an interview and pass an English and Civics test. If you are a foreign citizen or national who wants to become a United States Citizen, you need to go through a legal process called naturalization. This process has several requirements and steps that you must follow carefully. As an Immigration Lawyer, I can help you navigate the complex and often confusing immigration system and avoid any mistakes or delays that could jeopardize your chances of becoming a citizen. Some of the requirements for naturalization are: You must be at least 18 years old at the time of filing the application. You must have been a permanent resident (green card holder) for at least five years, or three years if you are married to a U.S. citizen. You must have lived in the state or district where you are applying for at least three months. You must have been physically present in the U.S. for at least half of the required residency period. You must demonstrate good moral character, respect for the U.S. Constitution and loyalty to the U.S. You must be able to read, write and speak basic English, unless you qualify for an exemption based on age, disability or length of residency. You must pass a test on U.S. history and government, unless you qualify for an exemption based on age, disability or length of residency. The steps for naturalization are:- Complete and submit Form N-400, Application for Naturalization, along with the required documents and fees. Attend a biometrics appointment to provide your fingerprints, photograph and signature. Receive a notice for your interview and test date. Attend the interview and test at a local USCIS office and answer questions about your application and background. Receive a notice of decision, which could be granted, continued or denied. If granted, receive a notice to take the Oath of Allegiance at a naturalization ceremony. Attend the ceremony and take the Oath of Allegiance to become a U.S. citizen. As you can see, naturalization is not a simple or easy process. It requires careful preparation, documentation and follow-up. That's why it is advisable to hire an experienced Immigration Lawyer who can guide you through every step and ensure that your application is complete, accurate and timely. We certainly hope you find this petition useful and helpful and hope for the best immigration experience you can have. We do have petitions on every subject area of immigration, and you might look at those if needed as well. Much attention has been focused on how states produce knowledge about the people they govern; far less has been written about those aspects of society that states choose to keep obscure. This book makes an original contribution to understanding state ignorance by focusing on one of the most complex and contested social issues of our day: the governance of irregular migrants. Tracing the evolution of state monitoring and control of irregular migrants from the 1960s to the present day across France, Germany and the United Kingdom, the authors develop a theory of 'state ignorance', setting out three complementary ways of understanding such oversights: ignorance as omission, ignorance as strategy, and ignorance as ascription. The findings upend dominant approaches, which tend to assume that states are preoccupied with producing knowledge about their populations, and argues that states have actually been keen to sustain ignorance about their unauthorised populations.

This thought-provoking collection brings together academics from a range of disciplines to examine modern slavery. It illustrates how different disciplinary positions, methodologies and perspectives form and clash together through a kaleidoscopic view to contribute a unique insight into critical modern slavery studies. Providing a platform to critique the legal, ideological and political responses to the issue, experts interrogate the construct of modern slavery and the anti-trafficking discourse which have dominated contemporary responses to and understandings of exploitation. Drawing on a range of global real-world examples, this is a vital contribution to the study of modern slavery.

  • af Jake Hopkins
    207,95 kr.

Jake Hopkins has created a tough, comprehensive, and thought provoking picture of his 25 years with the pre 9/11 United States Immigration and Naturalization Service. He takes the reader on a sometimes disturbing journey through the maze of Immigration Law and the enforcement of that law in the last quarter of the 20th Century. He provides clear picture of all phases of immigration enforcement operations in the interior US from the prevention of unlawful entries by aliens at Ports of Entry on the border, the apprehension of illegal aliens, investigations of massive fraud schemes of documents, marriages, and visa applications. Hopkins outlines the often tragic results of alien smuggling and the modern slavery still existing in the agricultural industry as well as the apprehension and removal of every criminal alien within his jurisdiction. While often troubling, he has also dedicated his memoir to the hope of demonstrating to Americans who believe in fair, controlled, and lawful immigration to the United States what is possible if we have the will to make it so. Hopkins tells us how we must defend our borders, enforce the powerful laws that already exist, and find an uncomplicated way to allow those who are simply seeking employment to temporarily enter the country lawfully to work in industries needing employees with no expectation of remaining permanently.

Alia's Voice is a warm, hopeful account of a real family, wrenched from their homeland and resettled in Southern Ontario. A young couple waited in Lebanon for nearly three years, choosing Canada on the strength of one friend who had moved to Edmonton. When their travel day finally arrived, the parents and four children were met at the airport in Toronto by an enthusiastic group from the two churches that had sponsored them. Their only Syrian friend was three provinces away. They knew no one. The mother, Alia, had only one word of English to greet her new Canadian friends: hello. Within the short space of three years, Alia was able to address a women's group in Oakville, Ontario, telling the story of what she had left behind. The group was spellbound as she described missing her homeland, but becoming aware, during her time in Canada, that she had become a changed person. The family became citizens in 2021, the soonest available date after their arrival in Canada. Readers will be moved, enthralled, and inspired, not to mention being proud of Canada's refugee sponsorship system that made this success story possible.
