Commentaries on the Conflicts of Laws: Foreign and Domestic in Regard to Contracts, Rights, and Remedies, and Especially in Regard to Marriages, Divorces, Wills, Successions, and Judgments (Volume 1) By Joseph Story, LLD Contents I-Introductory Remarks II-General Maxims of International Jurisprudence III-National Domicil IV-Capacity of Persons V-Marriage VI-Incidents to Marriages VII-Foreign Divorces VIII-Foreign Contracts Excerpt from Chapter I The earth has long since been divided into distinct nations, inhabiting different regions, speaking different languages, engaged in different pursuits, and attached to different forms of government. It is natural that, under such circumstances, there should be many variances in their institutions, customs, laws, and polity', and that these variances should result sometimes from accident, and sometimes from design, sometimes from superior skill and knowledge of local interests, and sometimes from a choice founded in ignorance and supported by the prejudices of imperfect civilization. Climate and geographical position, and the physical adaptations springing from them, must at all times have had a powerful influence in the organization of each society, and have given a peculiar complexion and character to many of its arrangements. The bold, intrepid, and hardy natives of the north of Europe, whether civilized or barbarous, would scarcely desire or tolerate the indolent inactivity and luxurious indulgences of the Asiatics. Nations inhabiting the borders of the ocean, and accustomed to maritime intercourse with other nations, would naturally require institutions and laws adapted to their pursuits and enterprises, which would be wholly unfit for those who should be placed in the interior of a continent, and should maintain very different relations with their neighbors, both in peace and war. Accordingly we find that, from the earliest records of authentic history, there has been (as far at least as we can trace them) little uniformity in the laws, usages, policy, and institutions either of contiguous or of distant nations. The Egyptians, the Medes, the Persians, the Greeks, and the Romans differed not more in their characters and employments from each other, than in their institutions and laws. They had little desire to learn or to borrow from each other; and indifference, if not contempt, was the habitual state of almost every ancient nation in regard to the internal polity of... ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. Heraldic Illustrations comprising the Armorial Bearings of the Principal Families of the Empire with pedigrees and annotations By John Burke, Esq., and John Bernard Burke, Esq. Contents Dedication Engraved Plates of Arms Pedigrees and Annotations, Explanatory, of the Engravings Mottoes, Translated and Elucidated Excerpt The Family of Saxe-Coburg is one of the most ancient and illustrious of the Sovereign Houses of Europe. Its Princes, who frequently commanded armies and acquired great military renown, were as eminent in peace as the munificent Patrons of Art, Science, and Literature. Originally Counts of Wettin, they became, by inheritance, Margraves of Meissen and Landgraves of Thuringia: and of the latter potent Race sole Representatives at the decease of Hermann, Landgrave of Thuringia and Emperor of Germany. The Reigning Duke of Saxe Coburg Gotha is Chief of the Saalfeld Branch of the Ernestine Line of the House of Saxony. In that Line the Electorate vested at the decease of Albert III. in 1422, and remained until John Frederick, the Magnanimous, was deprived of his dominions by the Emperor Charles V. who conferred them, with the dignity of Elector of Saxony, on Duke Maurice of Meissen, Representative of the Albertine branch, and direct Ancestor of the present King of Saxony. Thus, but for the misfortunes of the Elector John Frederick, (Prince Albert's immediate Progenitor) the Chief of his House--the Grand Duke of Saxe Weimar--would now be invested with the Sovereignty of Saxony. His Royal Highness Prince Albert bears for... ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. A Guide through the Worcester Royal Porcelain Works By Richard William Binns and E.P. Evans The extraordinary mania for Pottery at the present time is not peculiar to our age. The history of our art throughout the world teaches us that it has been cultivated in all ages and under every variety of circumstance, and at times under the most distinguished patronage. There are many reasons why this important and truly beautiful art should engage the attention of the people. The learned Brongniart says ("Traite des Arts Ceramiques")-"I know of no art which presents in the study of its practice, its theory, and its history, so many interesting and varied considerations as the Ceramic art." We regard it as the graphic medium of antiquity. The clay so sensitive in the hands of the potter exhibits the most subtle expression of the actor's will, and presents to us the mind and character of ancient peoples who may have left no other trace behind. Birch says-" The history of the art of working in clay, from its rise amongst the oldest nations of antiquity till the present time, resolves itself into two great divisions, which have engaged the attention of two distinct classes of enquirers, namely, the technical or scientific part, comprising all the details of material, manipulation and processes; and, secondly, the historical portion, which embraces not only the history of the art itself, and the application of ancient literature to its elucidation, but also on account of the light thrown by monuments in clay on the history of mankind." The study, therefore, is neither deficient in dignity, nor limited to trifling investigations, nor rewarded with insignificant results. A knowledge of the origin and progress of any branch of art must always be of immense importance to its future development and improvement. This is particularly true of the art of working in clay, both from its universal diffusion and from the indestructible nature of its products. Entirely sympathising with these sentiments, the present brochure has been written, not with the idea of giving a history of porcelain manufacture in its technical or scientific details, nor the history of the art with reference to nations, but for the purpose of answering the questions so frequently put by visitors, respecting the various processes of manufacture at the Worcester Royal Porcelain Works. Everyone being interested in the manufacture of porcelain, it is our desire to explain the processes in the most simple manner, and to endeavour to make a visit instructive as well as interesting, and possibly direct attention to the geological, chemical, and technical studies which are involved in its practice. ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. SLINGSBY AND SLINGSBY CASTLE By Arthur St. Clair Brooke, M.A. CONTENTS Introduction The Making of Slingsby, and Slingsby in Domesday Some Lords of Slingsby The Wyvilles The Castle The Church and Rectors Some Changes and Survivals Appendices Chapter 1 Excerpt SLINGSBY is one of a number of villages situated along the southern edge of the vale of Pickering, in the north-riding of Yorkshire and the wapentake of Ryedale. Pickering vale opens on the east towards the sea, and is encircled in other directions by three ranges of hills: (1) The Tabular hills on the north; (2) the Hambleton hills on the west; (3) the Howardian hills on the south. The Tabular hills have their name from their nearly table-like summits. They extend from the coast at Scarboro' westward to Black Hambleton (1309 feet), a tract of country which Arthur Young speaks of as "not having the epithet black given to it for nothing, for it is a continual range of black moors." At this point the high ground curves round to the south, forming the lofty plateau of the Hambleton hills--a name somewhat fancifully derived by Eugene Aram in his projected lexicon from "hemel" and "don," signifying the "heavenly mountain"; and given, he adds, to these hills, "not from their elevation, but from their figure to the eye, which is that of half a globe with the convexity upwards." The Howardian hills, the least elevated of the three ranges, extend from Gilling to Malton, and are called after the family of Howard, whose seat is in their neighbourhood. They seem to have been without a name until Marshall in his "Rural Economy of Yorkshire," written in 1796, so christened them (vol. i p. 12). A spur of the Hambleton range, called Cauklass Bank, runs into the western portion of the vale of Pickering, dividing it in this part into Ryedale, on the north, called after the river Rye; and Mowbray vale on the south, called after the famous house of Mowbray. The vale of Mowbray, however, is not confined to this part of the vale of Pickering, but extends through the gap, which at Gilling and Coxwold divides the Hambleton from the Howardian hills into the north-eastern portion of the vale of York, as far north as the border of Cleveland; for the Mowbrays had possessions in all this region, their chief seat being at Tresch (i.e. Thirsk), where they had a castle. ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. A Genealogical Memoir of the Lo-Lathrop Family in this Country, Embracing the Descendants, as Far as Known By Rev. E.B. Huntington The Rev. Mr. Huntington's Genealogy of the Lothrop-Lathrop Family was substantially ready for the press in 1872-1878, the material having been collected long before. The panic of 1878 and his untimely death in 1877 caused delays in the publicatìon. The manuscript needed revision, there were corrections and additions to be made. Had the author lived, it is hardly possible there should nave been no mistakes in such a work, and with him passed away all knowledge of many of the references and authorities which he used, and some of the errors were thus placed beyond correction. In August, 1888, a friend, though overladen with business cares, kindly offered to see the work through the press, but without being able to give it any thorongh editorial revision. Much new material has been added, a voluminous correspondence has been entered into, many corrections, made necessary by an illegible manuscript and other causes, have been made, and the publicatìon has thus been unavoidably delayed until now. Many acknowledgments should be made for kindly aid given by those who were interested in the work. To name them all would be impossible, to omit any would be invidious, and only the general thanks of a grateful heart can now be tendered. ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. Excerpt from Chapter 9 A Contract is "the consent of two or more in "the same design, mutually expressed with a "view to constitute or abolish some right or "obligation." We have already seen the necessity of frequent translations of property by consent of the proprietor, and of a constant, social intercourse of offices among men in giving mutual assistance. The law of nature requires and obliges us all to be ready voluntarily to do all kind offices in our power, and every good man is thus disposed; and yet express contracts about them are necessary among the best of men. For tho' men are obliged to social offices, yet they are not bound, except humanity to the indigent requires it, to give their goods or labours to others for nothing. Such obligation would have all the bad effects of a community of goods. The wealthy need more frequently the labours of the indigent, and the indigent must be supported by the compensations they get for them. There must be mutual agreements about these things. . . ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. Cilley Family By JP Cilley Excerpt Some of the family object to the implied derivation of the name in my first article, and refer me to the Scilly Isles, formerly spelled Silly, Silley, and Scilley, and whose old British appellation was Syllah, signifying "rock consecrated to the sun." I am also referred to a rare pamphlet, in the Philadelphia Library, by Francis Gawler, London, 1659. On page 271 of the volume and 21 of the pamphlet, entitled "A Record of some persecutions inflicted upon some of the Servants of the Lord in South wales," &c., --meaning Quakers, --appears the following incidental mention of the name: "Again Mary Richard and Mary Moss of Pennarth in Cilley for clearing their conscience to John Cutts, Priest were haled, and beaten and drawn up a pair of stairs and their feet in the stocks by the Constable and Priestman." This is in the vicinity of the supposed origin of the family in Somerset Co., Eng., and with the fact, that the families of Cutts and Cilley were contemporary in NH, may account for the name. Others insist on the authority of Burke, that the name is of Northman origin, and pursue a zigzag course through the Oxford Chronological tables and the Advent of Saxons into Normandy till they place themselves in Germany and pounce on the town of Cilli, --spelled also Cilly and Cilley, -- in the Southern part of Styria, and commence the genealogy thusly. But when we read that the 2 Barbarra, for her libertine conduct was called the German Messlaina, and is described by an Austrian historian as "one who believed neither God, angels or devil--neither hell or heaven," and consider the trouble of the family might make in Europe by claiming their rights of succession, we turn with infinite relief to the fisherman magistrate of the Isles of Shoals and make peace in the family by saying that the undoubted origin of the name was from the amphibious occupations of its early members as fishermen and mariners, called Sea-ly (sea-like). It thus appears on the early records of the Isles of Shoals, written in a bold and very legible manner. When the owners of the name left the sea for the land, the spelling of the name for two or three generations floundered about like a fish out of water, until Gen. Cilley, by his revolutionary fame, anchored it as Cilley. I have been unable to connect the Isles of Shoals Sealys with Capt. Robert Seely, though it is evident they came from... ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. Genealogical Gleanings in England (Volume I) By Henry F. Waters AM INTRODUCTION The efforts made by the New England Historic Genealogical Society, through its Committee on English Research, to procure funds sufficient to enable it to make an exhaustive search of the English Records, on a plan never before attempted, for everything which concerns the family history of the early settlers of this country; its great good fortune in securing the services of the eminent antiquary, Henry FitzGilbert Waters; his peculiar qualifications for the task, and the superiority of the method adopted by him, are all set forth in the New England Historical AND Genealogical Register for July, 1883. Mr. Waters sailed for England May 5, 1883, and at once entered upon his great work. The step thus taken was a most important one, and marked a new departure in genealogical research. The notes printed in the Register for July, 1883, were the results of Mr. Waters's first few days' work among the records of the Prerogative Court of Canterbury, Somerset House, London. They arrived here barely in time for publication in that number of the Register, and were a foretaste of what was to come. Before a twelvemonth had passed he had accumulated a vast amount of historical and genealogical material, including abstracts of more than six hundred wills relating to American families, and he has since then industriously added to his invaluable collections, until they are now unequalled both in extent and in importance. Some of the results of his researches, under the title of "Genealogical Gleanings in England," have been given to the public in the New England Historical and Genealogical Register, the organ of the Society. It has now been deemed advisable to reprint some of these "Gleanings" in a form more convenient for reference. The present volumes include the various instalments published in the Register from July, 1883, to January, 1899, inclusive. In addition to these genealogical researches, Mr. Waters has made historical discoveries of the highest value. We owe to him the finding of the Winthrop map and the Maverick MS, two of the most important contributions made in our day to our early colonial history. These discoveries excited great attention among historical students, not only in this country, but also in England. ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices. It is hoped that by its means the teacher may convey a sound elementary knowledge of the number, nature, relative positions and uses of the principal organs of plants, of the order and way in which they grow, and in which plants multiply, and of those resemblances which exist amongst them, by a comparison of which their true relationships are known and themselves classified. In using this Primer the plants indicated are, whenever possible, to be put into each pupil's hand. Hence, to facilitate its use, I have placed at the end an Index of the plants referred to in it. These may be procured in the country, or from any intelligent nurseryman. Many of them should be grown in every school-garden, and arranged in it systematically, so that the teacher may have the same means of displaying to his pupils the principles of classification at the great founder of the natural classification of plants, Bernard de Jussieu, had after arranged the Garden of the Palace of Trianon after its establishment by Louis XV. The teacher should further have a copious supply of dried flowers, and other parts of these plants so preserved as that the pupil can, after moistening them in warm water, separate their organs. Much may thus be learnt when fresh plants cannot be obtained, and a rehearsal of the summer's lessons upon such dried specimens is a most improving exercise. He should also have a supply of preserved fruits, seeds, sections of stems, and of mounted preparations of the tissues and minute parts of plants adapted for exhibition under the microscope. ------------------------------------------------------------------------------------------------------------------------------------------ Windham Press is committed to bringing the lost cultural heritage of ages past into the 21st century through high-quality reproductions of original, classic printed works at affordable prices.
