This paper studies the benefits and edges of the payment order process and its possible inclusion in Paraguayan law; Therefore, it was decided to investigate the "General aspects of the payment order process and its incorporation in the Preliminary Draft of the General Procedural Code and in the legislation of the Republic of Paraguay", setting as a general objective to determine the feasibility of the incorporation of the payment order process in the Preliminary Draft of the General Procedural Code and in the legislation of the Republic of Paraguay, based on a study of its general aspects, and based on the hypothesis that the payment order process, complying with strict requirements, is presented as a viable alternative within the Preliminary Draft of the General Procedural Code for the Republic of Paraguay and currently in force in the Procedure for the Reparation of Damage in the criminal jurisdiction. A non-experimental methodological design was used for the research, at a legal-descriptive level and with a legalistic or dogmatic approach, resorting to immediate formal (direct) sources.

Dans ce document, nous étudions les avantages et les inconvénients de la procédure d'injonction de payer et son éventuelle intégration dans le droit paraguayen ; Il a donc été décidé d'étudier les "aspects généraux de la procédure d'injonction de payer et son incorporation dans le projet de code général de procédure et dans la législation de la République du Paraguay", l'objectif général étant de déterminer la faisabilité de l'incorporation de la procédure d'injonction de payer dans le projet de code général de procédure et dans la législation de la République du Paraguay, sur la base d'une étude de ses aspects généraux et de l'hypothèse selon laquelle la procédure d'injonction de payer, qui répond à des exigences strictes, se présente comme une alternative viable dans l'avant-projet de code général de procédure de la République du Paraguay et dans la procédure de réparation des dommages actuellement en vigueur devant les juridictions pénales. Une méthodologie non expérimentale a été utilisée pour la recherche, à un niveau juridico-descriptif et avec une approche légaliste ou dogmatique, en recourant à des sources formelles immédiates (directes).
