Le cas se présentait sans doute, et d'autres de même ordre; mais ils étaient si rares qu'il est permis d'affirmer que sur un millier de lettres de cachet délivrées par l'administration, c'est à peine si deux ou trois, trois ou quatre peut-être, concernaient une affaire de ce genre, et un historien désireux de juger d'un coup d'oeil l'ensemble de l'institution pourrait presque les négliger. Quelles sortes d'affaires concernaient donc les neuf cent quatre-vingt-seize ou neuf cent quatre-vingt-dix-sept lettres de cachet restantes ? - C'étaient habituellement des affaires de police et des affaires de famille. En matière de police, les lettres de cachet ne laissaient pas de rendre service, étant donnée cette étonnante organisation judiciaire, dont la procédure remontait à un âge reculé, et que l'ancien régime conservait soigneusement. Malesherbes écrit dans son Mémoire: - Le juge, excepté en flagrant délit, ne peut arrêter que par décret de prise de corps, celui-ci ne se prononce qu'après information, les témoins ne sont entendus qu'après avoir été assignés, le ministère ne les fait assigner qu'après avoir obtenu la permission d'informer, et il n'obtient cette permission qu'en rendant plainte. Pendant ce temps, le coupable s'enfuit. En ce cas, le procureur-général ou ses substituts demandent des lettres de cachet. - Le prévenu était en prison qu'un décret de prise de corps donné par un tribunal régulier, châtelet ou parlement, intervenait; aussitôt l'ordre du roi, - c'est ainsi que l'administration nommait une lettre de cachet, - était levé, et le prisonnier passait aux mains de la justice ordinaire. Dans ces circonstances, l'ordre du roi peut être assimilé au mandat d'amener que lancent nos juges d'instruction...
