... Loin que ces Germains entrassent en maîtres dans l'empire, ils y entraient comme colons. Or le colonat, à cette époque, n'était pas autre chose que le servage de la glèbe. Un colon était attaché à un champ pour toute sa vie, il ne pouvait s'en éloigner même une heure; les lois impériales l'appellent servus terroe. Non-seulement ces Germains ne s'emparaient pas de la terre, c'était au contraire l'empire qui s'emparait de leurs personnes pour les enchaîner à la terre. Le code théodosien mentionne des nations barbares qui avaient été ainsi introduites de force dans l'empire, fixées au sol et assujetties à la dure condition du colonat. Les Germains faisaient effort pour se tirer de cette servitude; on cite des Francs qui, transplantés comme colons dans l'Asie-Mineure, construisirent des barques et revinrent par mer en Germanie. L'empire redoubla de sévérité, comme on peut le voir en suivant dans les codes la progression des lois relatives au colonat, pour retenir de force ces étrangers. Il y a des coïncidences frappantes. Le colonat ou servage de la glèbe, inconnu dans les premiers siècles de l'empire, fut constitué et se développa à mesure que s'accrut le nombre des Germains amenés par chaque victoire. Peut-être y aurait-il quelque témérité à prétendre que cette introduction forcée des Germains ait été la source unique du servage de la glèbe; mais on peut affirmer au moins que dans cette classe des serfs, qui commence au IIIe siècle et qui ne finit qu'en 1789, il y a eu beaucoup de sang germanique...
