Over the past decades, there have been several amendments to the US and Canada's immigration and refugee policies, as well as major developments across the disciplines of international migration and refugee law. This study tackles the Safe Third Country Agreement (STCA) between the US and Canada, which effectively entered into force in the year 2004. The study examines the trajectory of this agreement, the debates and arguments that surrounded it during its early stages, as well as how these debates have evolved alongside developing forced migration realities since the STCA's implementation. It looks into whether or not these developments challenge the STCA, render it ineffective, and consequently put US-Canadian relations into question. It addresses international mechanisms, local realities and bilateral factors, which contribute to the refugee/migration debate between the two states - namely the 1951 Refugee Convention and the 1967 Protocol. It aims to determine the extent to which the international refugee crisis, the Trump Administration, and developments in international law have affected the status of the STCA and subsequently, the relationship between the US and Canada.
This book looks into the sexual assault of irregular/illegal immigrant women and girls throughout their arrival to the European Union borders and borderlands between the period of 2011 and 2018, through an Intersectional lens. It intends to analyze this sensitive human rights issue through grasping the cultural obstacles and procedures at European borders which have fueled the violation of this fragile migrant group¿s human rights, while also supporting this argument with academic research, statistical data and reports on irregular migration from international and regional organizations, security mechanisms at borders, and statistics on sexual abuse and exploitation during the aforementioned period. It intends to explore the manner in which several factors and developments at European borders and in the borderlands have resulted in a more dangerous migration journey for these women and girls, as well as the manner in which these developments further perpetuate the likelihood of sexual violence of migrants, and female migrants in particular. This book aims to comprehend the linkages between academic research and the supporting statistical information through the lens of Intersectionality Theory ¿ a theory which will allow for the issue to be tackled across its different layers and across all the intersections and overlaps these layers create. This book highlights multiple instances of sexual violence throughout the journey, and upon arrival of these migrant women and girls to the European borders and borderlands, and subsequently emphasizes that these events further perpetuate the vulnerability to sexual assault for irregular migrant women due to the very ¿illegal¿ nature of their journeys.Through this lens, this process is examined across: power dynamics, security, legal status, and gender. Through examining these realities and power systems, it becomes evident that this particularly vulnerable group of women and girls from developing countries escaping war, economic burdens and conflict, are ostracized and subordinated in a number of interconnected patterns. This book highlights a need for more gender-sensitive policies because the group of women in question has close to no viable resource for justice within a system that currently acts against them and views them as criminal or ¿illegal¿.
Germany will spend around $6.6 billion to cope with an estimated 800,000 refugees expected to have entered the country in the year 2016; this reality indeed extending further into 2017. Despite this overwhelming number of people entering the country, Chancellor Angela Merkel stated that there is "e;no legal limit to the number of asylum seekers Germany will take in in the coming years."e; The announcement by Merkel's coalition government followed Germany and Austria opening their borders to the large numbers of refugees making their way north and west from the Middle East, Africa and elsewhere. In particular, this statement came after the Syrian refugee crisis created the biggest refugee crisis the world has seen since the Second World War. Germany is seen as the immigration hub of Europe. It also happens to be the second most popular destination for immigrants after the United States of America. Germany is also the country in Europe with the highest numbers of foreign nationals to date. Germany established a new immigration law in 2005 which was born out of a realization that it was coming to terms with a demographic crisis stemming from an ageing population and further complimented by a sharp decline of national birth rates. In foresight, and within this unfortunate context, migration was seen by much of the German political class as an economic necessity, and the answer to the German economic and demographic time bomb. Between the years 2009 and 2014, annual net migration in Germany rose from 100,000 to 580,000 individuals. Moreover, the inflow of foreign nationals increased from 266,000 to 790,000 individuals. As of January 2015, approximately 10% of residents in Germany were foreign nationals, with around 12% born outside the country. Naturally, these figures have all risen significantly following Merkel's decision to allow what has reached one million refugees and migrants into Germany across 2016 and moving into 2017. Moving from this reality, the research will focus on the importance of the compliance of Germany's migration policy with International Refugee and Migration Law, as it is crucial for the country's survivability and move forward throughout this phase of its history. The importance of the research lies in whether or not Germany's migration policy towards the Syrian Refugees in particular complies with its duties toward international law embodied in the treaties and conventions it has committed to.
