How we interpret and understand the historical contexts of legal education has profoundly affected how we understand contemporary educational cultures and practices. This book, the result of a Modern Law Review seminar, both celebrates and critiques the lasting impact of Peter Birks' influential edited collection, Pressing Problems in the Law: Volume 2: What is the Law School for? Published in 1996, his book addresses many critical issues that are hauntingly present in the 21st century, amongst them the impact of globalisation; technological disruption; and the tension inherent in law schools as they seek to balance the competing interest of teaching, research and administration. Yet Birks' collection misses key issues, too. The role of wellbeing, of emotion or affect, the relation of legal education to education, the status of legal education in what, since his volume, have become the devolved jurisdictions of Northern Ireland, Wales and Scotland - these and others are absent from the research agenda of the book.¿Today, legal educators face new challenges. Sodann erfolgt eine Darstellung der Entwicklung der Reform des Rechtsberatungsgesetzes einschließlich der beabsichtigten Änderungen, ausgehend von den überholten Begriffen der Geschäftsmäßigkeit, der Rechtsbesorgung und der Rechtsberatung hin zu dem zentralen Begriff der Rechtsdienstleistung. Die maßgeblichen inhaltlichen Änderungen werden gegenübergestellt. Eine inhaltliche Auseinandersetzung mit der Kritik an dem Gesetzentwurf zum neuen RDG schließt sich an. Sodann werden die Auswirkungen des neuen RDG auf die Tätigkeit der Rechtsschutzversicherungen im Rahmen ihres Rechtsberatungsservice dargestellt. Die Ausführungen schließen mit einer zusammenfassenden Stellungnahme und einem Ausblick.Ziel des Gesetzesentwurfes ist der Schutz der Ratsuchenden und die Stärkung des bürgerlichen Engagements. Dies gehe einher mit einer Deregulierung und Entbürokratisierung. Es sollen nur noch solche Dienstleistungen dem Verbotsbereich des Gesetztes unterstellt werden, die eine substanzielle Rechtsprüfung erfordern und sich nicht auf die bloße Anwendung des Rechts beschränken. Diese Ziele sollen dadurch erreicht werden, dass Rechtsdienstleistungen durch Nicht-Anwälte zugelassen werden sollen. Alle Berufsgruppen sollen Rechtsdienstleistungen als Nebenleistungen anbieten können, beispielsweise die Beratung eines Architekten zu baurechtlichen Fragen.Der Gesetzesentwurf ist bereits auf heftige Kritik gestoßen. Insbesondere die Anwaltschaft sieht das Ziel, den Schutz der Ratsuchenden zu gewähren, gefährdet. Eine qualifizierte Rechtsberatung werde nämlich nicht mehr sichergestellt. Die Befugnis zur Rechtsberatung werde nicht mehr an eine Ausgangsqualifikation geknüpft. Auf dem Gebiet der Rechtsberatung könne ¿ unabhängig von der Vorbildung ¿ praktisch jedermann tätig werden. Für Ratsuchende werde es damit schwieriger als bisher zu erkennen, welcher Fachmann tatsächlich Fachmann ist.
