The idea for this translation was born during my English-held master's program, when I realized that a translation of the German Energy Industry Act was not publicly available. Now that the need for an English version of the German Energy Industry Act has been surfaced regularly during my daily work, I have realized the idea with this book. I hope that this translation will be a useful tool and, at best, perhaps even serve to convey the ideas of the Energy Industry Act beyond the borders of Germany. In diesem Thesenpapier wird das Thema der öffentlich zugänglichen Ladeinfrastruktur für Elektromobilität mit Blick auf den geltenden energiewirtschaftsrechtlichen Rahmen in Deutschland untersucht. Dabei wird das Aufladen der Elektrofahrzeuge an öffentlich zugänglichen Ladepunkten sowohl in regulierungs- und kartellrechtlicher als auch ökonomischer Hinsicht betrachtet. Ausgangspunkt dieser Untersuchung ist das sogenannte Reichweitenproblem (oder auch "Reichweitenangst"), d.h. die Sorge des elektromobilen Autofahrers, mangels einer vorhandenen und auch tatsächlich nutzbaren Ladeinfrastruktur das Reiseziel nicht zu erreichen. Die deutsche Energiewirtschaft ist in diesem Zusammenhang aufgefordert, eine Ladeinfrastruktur für eine Million Fahrzeuge im Jahr 2020 bereitzustellen und hierfür effiziente Marktprozesse zu entwickeln.Anhand von vier Thesen wird nachgewiesen, dass die öffentlich zugängliche Ladeinfrastruktur Teil des Stromnetzes ist und ein regulatorisches Einschreiten aufgrund unterschiedlicher Formen des Marktversagens notwendig ist. Das Thesenpapier schließt mit konkreten Handlungsvorschlägen an den Gesetzgeber.Die hier präsentierten, rechtlichen Lösungsansätze sollen letztlich dazu dienen, dem elektromobilen Auto- oder Motorradfahrer bundesweite, sehr effiziente, preisgünstige und ausreichende Lademöglichkeiten zu eröffnen.

This book tackles the problem of the insufficient and expensive charging infrastructure in Germany. The legal solutions proposed here could ultimately serve to offer e-motorists around the country highly efficient and competitively priced charging options.
