Numa perspectiva democrática, em que extensão e alcance da jurisdição são ampliados, há necessidade de se considerar diversas manifestações de juridicidades emergentes, como as advindas de práticas que ocorrem na, para e pela comunidade. Entende-se comunidade como agrupamento humano com vínculos de pertencimento e significado. Diferente de um retorno à "comunidade imaginada," que parte de ideia fixa do coletivo perdido, a justiça comunitária trata a comunidade enquanto opção política e ética emancipatória, definida no presente, com base em diálogos provisórios e contínuos que consideram a diversidade. Ela propõe tratamento adequado aos conflitos partindo da consideração de diversas maneiras de se compreender juridicamente a realidade. Sua proposta consiste em prevenir violências e produzir transformação, solução e gestão de conflitos no espaço interno da comunidade, por meio da ação de seus próprios agentes, para o estabelecimento de um estado de paz pautado em pertencimento, participação e conexão de seus membros. É, portanto, forma de democratização da produção jurídica; neste caso, feita de forma direta pelos meios, linguagem e costumes da comunidade, sendo mais acessível e compreensível aos seus membros, além de mais sensível e familiarizada às particularidades do grupo do que abstrações do "homem médio" do direito estatal monista. A pesquisa focou a verificação das formas e impactos da materialização da justiça comunitária no Brasil na experiência da Região do Nacional, em Contagem, Minas Gerais, sob o Programa Conjunto da ONU "Segurança com Cidadania: prevenindo a violência e fortalecendo a cidadania com foco em crianças, adolescentes e jovens em condições vulneráveis em comunidades brasileiras," entre os anos de 2010 e 2013. O problema central disse respeito à efetividade do Segurança com Cidadania, segundo a perspectiva de seus usuários e executores. Considerando o resultado de mais de um ano sem homicídio de jovens no Nacional, tinha por hipótese que o Programa havia sido efetivo. Houve ainda a preocupação de identificar os impactos e transformações que continuavam em curso no território mesmo após a finalização das atividades do Programa. Para tanto, foi realizada pesquisa documental e bibliográfica, mas foi a pesquisa de campo a grande ênfase metodológica do trabalho. A proposta inicial restringia-se à realização de entrevistas semi-estruturadas do tipo narrativo; com o contato com a comunidade, o estudo de caso converteu-se em pesquisa-ação. O grande destaque do Segurança com Cidadania foi a utilização da metodologia do PNUD, considerando os recursos e potencialidades locais e envolvendo os agentes comunitários em todo o processo decisório e executório de projetos, programas, serviços e políticas públicas. Pautada em policentrismo decisório, práticas restaurativas, participação e influência da comunidade, a utilização da metodologia do PNUD no Nacional demonstrou a reflexividade entre métodos de tratamento de conflitos e cultura. Com marco teórico em Clifford Geertz, a pesquisa foi estruturada a partir da compreensão de que todo Direito é saber local, não só no que tange ao seu lugar, época e categorias; mas também em virtude das construções mentais de que parte sobre o que é possível - permitido, facultado ou proibido. Como saber local, pauta-se em racionalidades e em sensibilidades jurídicas.
