This book examines the social and legal regulation of domestic violence (DV) within the Kesarwani business community following the enactment of the Protection of Women from Domestic Violence Act 2005. It analyses the existence of the formal law in Kolkata and the relevance of the law in the familial lives of the Kesarwani community.The book offers a new conceptualisation of examining the relationship between formal law and social life. It provides a deep insight into how living with violence becomes a way of living and how the disposition to familial violence exists with social advantage and privilege. Explaining the functioning of the formal DV framework in non-legal terms as it exists on the paper, the book shows the ways in which this one law sought to democratise the family unit and overhaul the legal process in favour of DV victims in India. Most of all it hopes to show through the Kolkata study that caste and class, social structures that regulate and define social life globally, must remain critical to discussions of the social and legal regulation of DV in Kolkata, India or anywhere in the world. The book uses ethnography as a research methodology and traverses different locations in the Kesarwani community, and outside the community in Kolkata, to examine the relevance of the formal law in the lives of Kesarwani women. While the study is in India (and in a non-western context), the theme of the study - the social and legal regulation - remains relevant to contemporary debates on the efficacy of formal law in addressing coercive control in the western world. Notably, the book makes the formal domestic violence law legible for non-legal professionals by explaining the formal legal framework of domestic violence envisaged in the PWDVA.This book will be of interest to students and scholars of law, criminal justice, sociology, anthropology, women's studies, and political science. Dies führte zu einer intensiven rechtspolitischen Diskussion, ob ein solches Recht geschaffen werden soll. Die Einführung scheiterte jedoch an den erheblichen konzeptionellen Hürden. In der Praxis werden Daten ungeachtet dessen zunehmend vertraglich gehandelt, indem unter anderem sog. Datenlizenzen erteilt werden. In Anbetracht der steigenden Bedeutung dieser Vertragsform ordnet Nico B. Schur die Datenlizenz dogmatisch in das Lizenzvertragsrecht ein, bestimmt dessen rechtliche Grenzen und zeigt schließlich die rechtspolitischen Möglichkeiten einer Abbildung des Datenhandels über vertragliche Zugangs- und Datennutzungsrechte auf.
Eheschließung, Scheidung, Zugang zu Vermögen während und nach der Ehe, all dies war über die Jahrhunderte durch kirchliche und zivile Ordnungen strukturiert. Ziel des Heftes ist es, an den Schnittstellen zwischen verschiedenen Rechtslogiken nach Handlungsräumen von Männern und Frauen und nach den damit verbundenen Geschlechternormen zu fragen. Marriage, divorce, access to property during and after marriage, all this was structured over the centuries by ecclesiastical and civil provisions. Law thus had a very direct influence on personal life. The nineteenth century in particular was characterized by increasing legal unification, but particular rights continued to exist in larger territorial contexts. This legal heterogeneity as well as migration between different jurisdictional spaces could open up new possibilities to act. Conversely, different affiliations in regard to confession or ethnicity could pose great challenges for couples willing to marry. The aim of this issue is to ask at the interfaces between different legal logics about the spheres of action of men and women and the associated gender norms.
Contributions from members of the German Association for Comparative Law will be among the papers presented at this summer's twentieth International Congress of Comparative Law, to be held for the first time in Asia at Fukuoka, Japan, in July. In a strong range of topics, one focus during the six-day congress will be on questions of multiculturalism and language that concern both comparative law methodology and other legal fields such as family law. The legal framework is an essential instrument in modern rule-of-law societies for defining standards of societal life. Of course, ways of governance by law may vary between legal systems and cultures, but in the analysis of legal governance instruments, the interplay between substantive standards and their procedural enforcement is always of central importance. In the pursuit of certain political or social goals, a legal system is basically faced with two options: the exertion of influence on the behaviour of its citizens either by means of preventive or of reactive instruments. The relationship of these two regulatory tools is a key element for the analysis and understanding of a legal system. Freedom of testation allows an individual to make effective on his death dispositions of his property on the event of his death. Dependants' relief legislation in British Columbia and compulsory portion in Germany limit this freedom by providing testator's family members with a portion of the estate. However, out of the two, only the legislation gives courts the discretion to change testamentary provisions, by making them, in some cases, entirely ineffective.A comparative analysis of the application, legal character, history and purpose of the limitations leads to the conclusion that the freedom of testation is significantly more limited under British Columbia's legislation than it is under the German law. The author proposes a solution that increases the freedom, adds predictability and reduces subjectivity of the application of the dependants' relief legislation in British Columbia.
As lawyers we are normally interested in various substantive areas of law; and as comparative lawyers we are interested in finding out about the differences and similarities between national legal systems. In vielen Staaten bezieht die öffentliche Hand zur Erfüllung von Aufgaben der Daseinsvorsorge auch private Unternehmen ein. Azar Aliyev untersucht den Konzessionsvertrag als ein Instrument solcher öffentlich-privater Partnerschaften im russischen und kasachischen Recht. Konzession ist in beiden Staaten gesetzlich als Vertrag über Errichtung, Modernisierung, Betrieb und Rückübereignung von öffentlichen Infrastrukturobjekten durch Private definiert. Ebenso wie in Deutschland spielen dabei Privatrecht und öffentliches Recht zusammen; allerdings liegt der Schwerpunkt der Diskussion in den untersuchten Staaten anders als in Deutschland nicht im Verwaltungs-, sondern im Privatrecht.Die Arbeit diskutiert die Konzession auch als Mittel, im Kontext eher labiler juristischer Infrastruktur "Inseln der Stabilität" für langfristige und komplexe Großprojekte zu schaffen. Dabei werden viele Grundsatzfragen des Zivilrechts sowie des Wirtschaftsprivat- und Wirtschaftsverwaltungsrechts aufgegriffen und analysiert.
After the Vietnamese War, civil relations with foreign elements have increased and, consequently, private international law has gained some importance in Vietnam. However, both the relevant legal provisions and the practice of the courts in Vietnam are insufficient. Trinh Nguyen studies Vietnamese private international law in light of European developments. She focuses in particular on the general issues, contracts and torts. She describes and assesses the currently effective provisions of Vietnamese law and the corresponding judicial practice of the courts. Together with the knowledge of European private international law, with the main emphasis on the Rome I and Rome II Regulation, she makes use of comparative law to propose future developments for Vietnam based on the critical evaluation of the western doctrine.
The International Congress of Comparative Law , organised by the International Academy of Comparative Law , took place in Vienna from 20th to 26th July 2014. A number of different legal topics were discussed, such as: comparative law and unification of laws, legal education, private international law, environmental law, intellectual property, labour law, public international law, tax law and constitutional law. The reports written by the national commentators are based on the questionnaire set out by the general reporting secretary, who is an expert on their subjects. Most of the German reports are published in this book. Denne kommentar til forældreansvarsloven er beregnet til brug for fagfolk, der arbejder med børne- og familieret, men også til frivillige rådgivere og børneretligt interesserede studerende. Der er tale om en rent juridisk fremstilling, der dog er forsøgt skrevet i et tilgængeligt sprog. Det er derfor forhåbningen, at bogen kan læses af andre med interesse for området, og af samme grund drager bogen paralleller til de børnesociale regler, hvor dette er relevant. Forældreansvarsloven er blevet ændret et utal af gange siden dens ikrafttræden i 2017, hvor der har ligget et stort arbejde i at danne et overblik over de mange ændringer. Derudover er der tale om et område, hvor der træffes mange afgørelser. Bogen er opdateret frem til d. 16. oktober 2020.
Denne kommentar til familieretshusloven er beregnet til brug for fagfolk, der arbejder på det familieretlige område og for studerende. Der er tale om en juridisk fremstilling, og et vist forhåndskendskab til den almindelige juridiske terminologi er således en fordel for læseren. Opgaven med at skrive en kommentar til ægteskabsloven er ikke en opgave,man påtager sig uden grundige overvejelser. Området har i en lille menneskealderværet under konstant og kyndig behandling af dr.jur. Svend Danielsen,der har holdt det familieretlige område fuldt opdateret. Der er efterhåndenkommet en række nye tiltag på området, der har gjort, at det var på tide med en opdateret kommentar.Bogen er ajourført frem til april 2019

Kompendium i Skilsmisseret er udarbejdet med det formål at give studerende et overblik og grundlæggende viden om skilsmisseretten. Kompendiet indeholder eksempler fra praksis samt oversigtsskemaer, som skal lette forståelsen for faget. Kompendiet er ajourført med litteratur, lovregler og økonomiske satser indtil april 2017, og er primært baseret på bogen Skilsmisseret – de økonomiske forhold, 3. udgave 2017, af Linda Nielsen og Annette Kronborg. Stoffet er dog selvstændigt systematiseret, og kompendiet kan derfor benyttes af alle studerende, der beskæftiger sig med skilsmisseretten, som et behjælpeligt supplement til eksamenslæsningen. Kompendiet er inddelt i 6 dele:Del 1 indeholder en gennemgang af ægteskabssagen, herunder sagsbehandlingsregler for Statsforvaltningen, skilsmissegrunde og vilkårene for separation og skilsmisse.I del 2 gennemgås skiftesagen, som behandler formuedelingen, herunder regler for bodeling og tvister af økonomisk karakter.I del 3-6 gennemgås retsområder af betydning for både ægteskabssagen og skiftesagen:Del 3 omhandler aftaler mellem ægtefæller.I Del 4 gennemgås skilsmisserettens gebyrer og procesudgifter samlet.Del 5 omhandler reglerne for Internationale skilsmisser.Til slut gennemgår del 6 fremtidsvisioner for skilsmissesager, herunder de retspolitiske forslag til fremtidig lovgivning.
