This volume examines the relationship between Christian legal theory and the fields of private law.Recent years have seen a resurgence of interest in private law theory, and this book contributes to that discussion by drawing on the historical, theological, and philosophical resources of the Christian tradition. The book begins with an introduction from the editors that lays out the understanding of "private law" and what distinguishes private law topics from other fields of law. This section includes two survey chapters on natural law and biblical sources. The remaining sections of the book move sequentially through the fields of property, contracts, and torts. Several chapters focus on historical sources and show the ways in which the evolution of legal doctrine in areas of private law has been heavily influenced by Christian thinkers. Other chapters draw out more contemporary and public policy-related implications for private law.While this book is focused on the relationship of Christianity to private law, it will be of broad interest to those who might not share that faith perspective. In particular, legal historians and philosophers of law will find much of interest in the original scholarship in this volume. The book will be attractive to teachers of law, political science, and theology. The South Carolina Advanced Real Estate Principles: the "SCAP" Unit II Program has been developed to satisfy South Carolina's 30-hour Unit II requirement. The course also fulfills the Real Estate Commission's objective of giving South Carolina real estate licensees a carefully developed reinforcement of key real estate brokerage principles, concepts, and practices necessary to initiate a productive, professional career in real estate.Beyond an initial review of key principles, the SCAP Program takes on a further examination of essential skills and practices that will be necessary to meet client and customer transactional requirements within South Carolina's legal framework. Das Gesetz trat am. Juni 2016 in Kraft und nimmt Änderungen am bisherigen Mietrecht vor. Eingeführt wurden mit dem Novellierungsgesetz die sog. Mietpreisbremse und das Bestellerprinzip. In Deutschland führen die hohe Nachfrage nach Wohnraum und die Knappheit an preiswerten Wohnungen in Ballungsräumen - vor allem für Geringverdiener - zu Problemen. Um diese Problematik zu lösen, beschloss die Regierung, den Ländern für die Dauer von fünf Jahren die Möglichkeit einzuräumen, auf Wohnungsmärkten, die nachweislich angespannt sind, die Mieten bei Neuvermietungen auf eine maximale Anhebung von zehn Prozent der vorangegangene Miete zu beschränken. Das Bestellerprinzip hingegen soll dauerhaft bestehen bleiben und reformiert das Wohnungsvermittlungsgesetz dahingehend, dass der Auftraggeber, also derjenige, der den Wohnungsvermittler beauftragt, diesen auch zu bezahlen hat.Bislang wurden in Gebieten mit niedrigen Wohnungsangebot dem Mieter die Kosten für die Vermittlung einer Wohnung auferlegt, unabhängig davon, wer den Wohnungsvermittler beauftragt. In Gebieten mit einem Angebotsüberhang, beauftragten und bezahlten oftmals der Vermieter, den Vermittler. Angebot und Nachfrage regelten den Wohnungsmarkt. 2015 stand der Referentenentwurf für das MietNovG und Mieter- und Vermieterverbände sowie der Immobilienverband Deutschland (IVD) und der Deutsche Anwaltsverein (DAV) bekamen die Gelegenheit Stellungen zum Entwurf zu beziehen. Insbesondere die Möglichkeit, dass eine Mietendeckelung einen Rückgang von Investitionen auf dem Immobilienmarkt hervorruft und somit die Wohnungsknappheit noch erhöhen könnte, war ein starkes Negativargument der Reformgegner. Darüber hinaus könnten die Mietpreisbremse und das Bestellerprinzip verfassungswidrig sein und nicht geeignet, die Wohnungsknappheit zu bekämpfen, wenn es denn, so wie von der Politik propagiert, eine bundesweite Wohnungsknappheit gibt. Diese Arbeit soll zum einen die wesentlichen Neuerungen des Mietrechtsnovellierungsgesetzes aus 2015 aufzeigen und zum anderen seine tatsächliche Wirkung auf Märkte, die von Wohnungsknappheit gezeichnet sind, beurteilen. Weiter soll ein Ausblick auf das zweite Mietrechtsnovellierungsgesetz gegeben werden.
